Terms of service

These Terms of Service govern your access to and use of granitepeakgroup.store and any purchase you make from it. The site is operated by Granite Peak Research Group LLC, a limited liability company organized under the laws of the Commonwealth of Massachusetts, trading as Granite Peak Group, with its place of business at 68 Harrison Ave, Suite 605 #591444, Boston, MA 02111. By placing an order you agree to these terms. If you do not agree to them, do not place an order.

1. Who we are and how to reach us

Granite Peak Research Group LLC sells hardware, hand tools, fasteners, measuring equipment, workshop storage, safety equipment and site gear to trade, maintenance and consumer customers in the United States. We are reachable by email at support@granitepeakgroup.store and by telephone at (508) 304-3311 during Mon-Fri, 8:00 AM - 5:00 PM ET. Written correspondence may be sent to 68 Harrison Ave, Suite 605 #591444, Boston, MA 02111. We answer email within one business day in ordinary circumstances.

2. Eligibility and account information

You must be at least 18 years old and capable of forming a binding contract to purchase from this site. You may check out as a guest; you are not required to create an account. If you do create one, you are responsible for the accuracy of the information in it and for keeping your password confidential. You must tell us promptly if you believe your account has been used without your authorization. We may refuse service, close accounts, or cancel orders at our discretion, including where we reasonably believe an order is fraudulent, where a product has been listed at a manifestly incorrect price, or where we cannot verify the information supplied to us.

3. Products, specifications and availability

We describe every product as accurately as we can, including its material, size, grade, drive, capacity or other specification where that information determines whether the item is fit for your purpose. Photographs are representative. Minor variation in finish, packaging or component supplier can occur without notice and does not constitute a defect. Where a specification is critical to your application, we encourage you to contact us before ordering so that we can confirm it against the stock we actually hold.

Stock levels shown on the site reflect our inventory at the time of display and are not a guarantee of availability. If an item becomes unavailable after you order it, we will contact you with the option to wait, substitute or cancel for a full refund. We do not backorder without telling you.

4. Pricing

All prices are shown in United States dollars and exclude shipping unless stated otherwise. The price that applies to your order is the price displayed at the time you complete checkout. We reserve the right to change prices at any time before an order is placed. If a product is listed at an incorrect price because of a typographical or system error, we will contact you before processing the order and you may confirm at the corrected price or cancel without charge.

We do not operate tiered or negotiated pricing on this site. The price shown is the price everyone pays. Bulk and case quantities are listed as their own items where they are available.

5. Orders and acceptance

Submitting an order is an offer to buy. Our acceptance takes place when we send you an order confirmation, and a contract is formed at that point. An automated acknowledgement of receipt is not acceptance. We may decline any order before dispatch.

6. Payment

Payment is taken at the time of order. We accept major credit and debit cards. Card details are entered into a hosted, encrypted payment field and are processed by our payment provider; we do not receive, handle or store your full card number, expiry or security code on our own systems. All charges are one-time charges for the goods ordered. We do not operate subscriptions, negative-option billing, recurring charges, memberships, or automatic reordering of any kind. Your card is charged once, for the order you placed.

Your bank statement will show a separate charge for your order under the name of the payment provider we use. If you do not recognize a charge, contact us before disputing it and we will identify the order for you the same business day.

7. Shipping and risk

Shipping terms, carriers, cut-off times and delivery windows are set out on our Shipping and Delivery page and form part of these terms. Title and risk of loss pass to you on delivery to the address you supply. You are responsible for the accuracy of that address; we cannot redirect a parcel after dispatch and are not responsible for loss caused by an incorrect address supplied to us.

8. Returns, cancellation and refunds

Our Returns and Refunds page sets out your rights in full and forms part of these terms. In summary: unused goods in original packaging may be returned within thirty days of delivery for a refund of the purchase price. Orders may be cancelled without charge at any time before dispatch.

9. Warranty and disclaimer

Goods are supplied with the manufacturer's warranty where one applies, and with any warranty implied by law that cannot lawfully be excluded. Except as required by law and to the fullest extent permitted by it, goods are otherwise supplied without further warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Tools and site equipment carry inherent risk. You are responsible for selecting equipment appropriate to your task, for following the manufacturer's instructions, and for using suitable personal protective equipment. Nothing on this site is engineering advice.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the goods giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, loss of contract, downtime or the cost of substitute goods or labor. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited.

11. Intellectual property

The site, its text, photography, product descriptions, layout and the Granite Peak Group name and marks are owned by Granite Peak Research Group LLC or used under license. You may not copy, reproduce or use them commercially without our written permission. Product names of third-party manufacturers, where used, are the property of their owners and are used descriptively only.

12. Acceptable use

You may not use the site to place fraudulent orders, to test or validate stolen payment credentials, to scrape or bulk-harvest content, to interfere with its operation, or for any unlawful purpose. We log and investigate abuse and cooperate with our payment provider and with law enforcement where appropriate.

13. Export and lawful use

We ship within the United States only. You may not export goods purchased from us in breach of United States export control or sanctions law.

14. Privacy

Our Privacy Policy explains what personal information we collect, why, how long we keep it and what rights you have. It forms part of these terms.

15. Changes to these terms

We may amend these terms from time to time. The version in force is the one published on this page at the time you place your order. We date every revision below.

16. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Suffolk County, Massachusetts, and you and we each consent to the jurisdiction of those courts. Before commencing proceedings, please contact us; the overwhelming majority of issues are resolved by a single email.

17. Severability and entire agreement

If any provision of these terms is held unenforceable, the remainder continues in force. These terms, together with our Shipping, Returns, Privacy and Payment and Security pages, are the entire agreement between you and us in relation to your order and supersede any prior discussion.
